Agreement to these Terms

These Terms & Conditions govern access to and use of buttersupersoft.com, purchases from Butter Supersoft, customer accounts, reviews, and related services. “Butter Supersoft,” “Butter,” “we,” “us,” and “our” refer to the operator of the Butter Supersoft store. By using the site or placing an order, you agree to these Terms, the Refund Policy, the Shipping & Returns information, and any policies linked at checkout. If you do not agree, do not use the site or place an order.

Eligibility and account responsibility

You must be legally able to enter a binding agreement in your jurisdiction or use the site with the involvement of a parent or legal guardian. You are responsible for information submitted through your account, maintaining the confidentiality of account credentials, and notifying us of suspected unauthorized access. Information supplied at checkout must be current, complete, and accurate.

Products, custom work, and availability

Butter Supersoft products may be custom-made, made to order, embellished, or produced in limited runs. Product photographs and descriptions are intended to represent the item accurately, but colors may vary by screen and production details, texture, embellishment placement, and measurements may vary slightly where the product remains materially consistent with its description.

Availability, prices, descriptions, and product options may be corrected or updated without prior notice. Placing an item in a cart does not reserve it or guarantee acceptance of an order.

Orders and acceptance

An order confirmation acknowledges receipt of an order; it does not by itself mean that the order has been accepted. Butter Supersoft may accept, decline, limit, or cancel an order for legitimate reasons, including payment problems, suspected fraud, pricing or listing errors, unavailable materials, production limitations, shipping restrictions, or misuse of the site. If we cancel an order after payment has been captured, we will provide the remedy required for that cancellation.

Customers must review the selected product, size, color, embellishment, quantity, shipping method, pickup choice, and delivery information before submitting an order. Contact us immediately about an error; changes cannot be guaranteed after acceptance or production begins.

Prices, payments, and taxes

Prices are shown in U.S. dollars unless stated otherwise. Applicable taxes, shipping charges, and other disclosed charges are calculated or displayed during checkout. Payment is processed through the payment method selected at checkout and is subject to the provider’s terms. You represent that you are authorized to use the submitted payment method.

Shipping and local pickup

Orders ship from Woodbury, New York. Shipping dates and delivery estimates are estimates rather than guarantees unless expressly stated otherwise. Butter Supersoft is not responsible for a delay caused by an incorrect address, carrier disruption, severe weather, force majeure, or another event beyond reasonable control, but we will reasonably assist with available shipment information.

Complimentary local pickup is available when offered at checkout, with no local-pickup fee. Pickup instructions, availability, and identity or order-verification requirements will be provided with the order information. Orders must not be collected until the customer receives notice that pickup is ready.

Final sale and order issues

Because Butter Supersoft products are custom-made, made to order, embellished, or produced in limited runs, all sales are final except where an order is damaged, materially defective, incorrect, canceled by Butter Supersoft, or applicable law requires another result. The Refund Policy forms part of these Terms and explains how to report an issue.

Reviews and submitted content

If you submit a review, photograph, comment, or other content, you represent that it is accurate to your experience, that you have the right to submit it, and that it does not violate another person’s rights. You grant Butter Supersoft a non-exclusive, worldwide, royalty-free license to host, reproduce, display, and use that content in connection with operating and promoting the store, subject to applicable law and the Privacy Policy. We may moderate or remove unlawful, abusive, misleading, irrelevant, or rights-infringing content.

Intellectual property

The Butter Supersoft name, logos, artwork, photographs, product designs, embellishment concepts, site design, text, graphics, and other store content are owned by or licensed to Butter Supersoft and are protected by applicable intellectual-property laws. Except for ordinary personal shopping use, no content may be copied, reproduced, distributed, modified, sold, scraped, or commercially exploited without prior written permission.

Prohibited use

You may not use the site to violate law; infringe rights; submit false, fraudulent, harmful, or malicious material; interfere with security or operation; attempt unauthorized access; scrape or harvest data through automated means that burden the service; impersonate another person; or facilitate payment fraud, chargeback abuse, resale fraud, or other misuse.

Third-party services and links

The store may rely on third-party services for hosting, payments, analytics, forms, shipping, social media, and other functions. A third party may apply its own terms and privacy practices. Butter Supersoft is not responsible for independent third-party content or services except to the extent required by law.

Disclaimer of warranties

To the fullest extent permitted by law, the site and its content are provided on an “as is” and “as available” basis. Butter Supersoft does not promise that the site will always be uninterrupted, error-free, or free from harmful components. Any warranty that cannot legally be excluded remains in effect to the extent required by law.

Limitation of liability

To the fullest extent permitted by law, Butter Supersoft and its owners, personnel, contractors, licensors, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from the site, an order, or these Terms. Where liability cannot be excluded, aggregate liability will not exceed the amount paid for the product or order giving rise to the claim, except where applicable law requires a different measure. Nothing in these Terms excludes liability that cannot legally be limited.

Indemnification

To the fullest extent permitted by law, you agree to indemnify and hold Butter Supersoft harmless from a third-party claim, loss, or reasonable expense resulting from your unlawful misuse of the site, infringement of another person’s rights, fraud, or material breach of these Terms. This section does not apply where prohibited by consumer law.

Changes to the site or Terms

Butter Supersoft may update the site, offerings, or these Terms. The effective date identifies the current version. Changes apply prospectively when posted unless applicable law requires otherwise. Material changes will not retroactively alter an accepted order where doing so would violate law.

Severability, waiver, and entire agreement

If a provision is found unenforceable, it will be enforced to the maximum lawful extent and the remaining provisions will remain effective. A failure to enforce a provision is not a waiver. These Terms and the policies incorporated by reference form the agreement concerning use of the store and purchases, except for an express written agreement signed by an authorized representative of Butter Supersoft.
